WELLSBURG, W.Va. (AP) – The commissioner of the Division of Motor Vehicles says a proposed ordinance in Brooke County to require ATV owners to register their vehicles and display decal stickers would violate state law.
Steve Dale said in a letter to Brooke County Commissioner Tim Ennis that decal systems for ATVs are not covered in state code that gives local governments the authority to regulate the vehicles’ operation.
The Intelligencer and Wheeling News-Register reports Ennis relayed the letter to county planning commission members this week. The plan would have required the stickers to be displayed after ATV owners pay county property taxes on the vehicles.
The proposal was intended to address resident complaints about ATV riders in recent years.
